these Terms of Use and your continued use of isupport constitutes
your acceptance to these changes. When using the isupport,
you shall also be subject to any posted guidelines, rules,
or license terms Htmlab, which may contain terms and conditions
in addition to those in these Terms of Use. Htmlab offers
no guarantees, and assumes no responsibility or liability
of any type with respect to the Service. You agree that
you will not hold Htmlab responsible or liable with respect
to the online Service or seek to do so.
The software and accompanying documentation
that is available to download is the copyrighted and/or
patented work of Htmlab. Use of the software is governed
by the terms of the license agreement that accompanies or
is included with such software. You will not be able to
use isupport unless you agree to the terms of such license
agreement.
HTMLAB MAKES NO EXPRESS OR IMPLIED
REPRESENTATION OR WARRANTY ABOUT THE SERVICE OR THE SOFTWARE
THAT YOU DOWNLOAD, INCLUDING WITHOUT LIMITATION (A) FITNESS
FOR A PARTICULAR PURPOSE, MERCHANTABILITY OR NON INFRINGEMENT,
(B) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE OR
SOFTWARE WILL BE ACCURATE, OR RELIABLE, (C) THE QUALITY
OF THE SERVICE WILL MEET YOUR EXPECTATION, AND (D) ANY ERRORS
IN THE SOFTWARE WILL BE CORRECTED.
THE USE OF THE SERVICE AND/OR THE
DOWLOADING OF ANY SOFTWARE IS DONE AT YOUR OWN DISCRETION
AND RISK AND WITH YOUR AGREEMENT THAT YOU WILL BE SOLELY
RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, LOSS
OF DATA, OR OTHER LOSS THAT MAY RESULT THEREFROM. NO ADVICE
OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU
FROM HTMLAB OR THROUGH HTMLAB'S WEBSITE SHALL CREATE ANY
WARRANTY NOT EXPRESSLY STATED IN THESE TERMS OF USE.
UNDER NO CIRCUMSTANCES WILL HTMLAB,
ITS EMPLOYEES, OFFICERS OR DIRECTORS BE LIABLE TO YOU FOR
ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL
LOSS AND/OR DAMAGES OF ANY KIND.
If any court of competent jurisdiction
finds any provision of these Terms of Use, or portion thereof,
to be unenforceable, that provision shall be enforced to
the maximum extent permissible so as to effect the intent
of the parties. The other provisions of these Terms of Use
shall continue in full force and effect.
